General terms and conditions Frümel
Applicable to all purchases made through frumel.com
Article 1 - Definitions These terms and conditions mean:
Consumer: any visitor to the webshop, natural person or legal entity, who places an order through frumel.com.
Day: calendar day.
Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
Durable medium: any means by which the consumer or entrepreneur can store and reproduce information personally and permanently.
Model form: the withdrawal form made available by Frümel for use of the right of withdrawal.
Entrepreneur: Frümel, which offers products and/or services to consumers at a distance.
Distance contract: a sales contract using only distance communication.
Technique for distance communication: means such as e-mail, telephone or web shop, where consumer and entrepreneur are not physically in the same location.
General Terms and Conditions: these present terms and conditions of Frümel.

Article 3 - Applicability
3.1 These terms and conditions apply to every offer by Frümel and every distance contract concluded via frumel.com.
3.2 By placing an order, the customer accepts these general terms and conditions.
3.3 Deviations are only valid if agreed upon in writing.
3.4 Unforeseen situations will be assessed according to the spirit of these terms and conditions.
3.5 Ambiguities regarding the interpretation of provisions will also be interpreted according to the spirit of these terms and conditions.
3.6 Frümel reserves the right to amend or supplement the general terms and conditions in the interim.
Article 4 - Personal data
4.1 Customer data will be kept confidential and used only for:
processing of orders;
improving the web shop experience;
Newsletters and offers (opt-in only).
Article 5 - The offer
5.1 Frümel sells mainly vintage second-hand items. User marks are possible. Customers agree to the condition of the product as described. Viewing before delivery is recommended.
Please note that if you have the furniture delivered without having viewed it beforehand, you may still decide not to accept it upon delivery. In that case, we will take it back immediately and you will receive the full Purchase amount in return. The delivery fee will not be refunded in this case.
If you decide you want to return the furniture only after delivery, then the return conditions as described in Article 8 apply. In this case, the previously paid delivery costs will not be refunded and the collection costs will be borne by the customer.
Standard delivery costs within the Netherlands when delivered by Frümel bus:
South & central Netherlands + Amsterdam: €55
Zeeland, northern Netherlands and other regions: €90
For delivery to Belgium or Germany, different rates apply upon request.
5.2 Information, pictures and descriptions are displayed as carefully as possible. Minor deviations do not give a right to compensation or dissolution.
5.3 Obvious errors in the offer (such as typing errors in prices) do not bind Frümel.
5.4 If two customers order simultaneously, the following applies: whoever orders first is entitled to the item. The other will be informed of this.
Article 6 - Prices and Payment
6.1 All prices are in euros and do not include shipping or delivery costs.
6.2 Almost all items are covered by the margin scheme; no VAT is mentioned on the invoice.
6.3 Payment can be made via:
Cash or payment request at pickup;
in advance via bank transfer;
iDEAL, Bancontact, PayPal, credit cards.
6.4 The product will only be delivered or shipped after full payment.
6.5 Frümel may change prices, for example in case of changes in legislation.
6.6 Offers are valid as long as stated on the website.
6.7 Customers outside the Netherlands are responsible for import duties and taxes.
6.8 Price and typing errors reserved.
6.9 Payment must be made within 7 business days.
6.10 Customers report incorrect payment details immediately.
6.11 Reasonable costs may be charged for non-payment.
6.12 Reservations are free for 1 week. After that, full payment is required for renewal.
6.13 After 2 weeks, storage will be charged.
6.14 Storage Table:€0-€50: 15% p/week
€50-€200: 10% p/week
€200: 5% p/week
Max. storage per week: €35
Article 7 - Delivery
7.1 Collection is by appointment only.
7.2 Foreign deliveries on request.
7.3 Frümel acts with care upon delivery.
7.4 Delivery to the specified address.
7.5 Delivery within 30 days unless otherwise agreed.
Article 8 - Returns
8.1 14-day cooling-off period from receipt. Notify return by e-mail.
8.2 Frümel bus delivery:
Not accepted on delivery: full refund, excluding delivery charges.
Return after delivery: collection costs are:
South & central Netherlands + Amsterdam: €125
Other Netherlands: €175
Belgium/Germany: on request
8.3 International:
Return at your own expense.
Refund upon damage-free receipt.
8.4 Postal shipments:
Report return within 14 days, ship within 7 days.
Shipping costs for customer.
Refund upon damage-free receipt.
8.5 Frümel may refuse returns for damage or use.

Article 9 - Intellectual property
All content (text, images) on the website is the property of Frümel and may not be used without permission.
Article 10 - Force majeure
10.1 In the event of force majeure, both parties are exempt from obligations.
10.2 If force majeure lasts longer than 2 months, either party may dissolve the agreement.
Article 11 - Liability
11.1 Frümel is only liable for damage caused by intent or gross negligence.
11.2 Frümel is not liable for consequential damage or loss of use.
Article 12 - The Agreement
12.1 An agreement arises upon confirmation by e-mail or telephone.
12.2 Only orders with complete details will be processed.
12.3 Reserved items will be held for up to 7 days.
12.4 Frümel may refuse an order or impose additional conditions if in doubt about payment.
Article 13 - Compliance and Warranty
13.1 Complaints about defects must be reported within 1 day.
13.2 Vintage products are older than 40 years; wear and tear and subsequent defects cannot always be foreseen and are at the buyer's risk.
Article 14 - Disputes
14.1 All agreements are governed by Dutch law.
14.2 The Vienna Sales Convention is excluded.
